Gujarat HC Registers Contempt Petition Over Toilet Incident During Virtual Hearing

Ahmedabad: The Gujarat High Court has filed a contempt petition against Abdul Samad for joining the virtual hearing online from the toilet. The registry has been ordered to submit a report in this case on July 14 and the technical team has been advised to keep an eye on such incidents.

On June 20, when a petition related to Negotiable Instrument was being heard in the court of Judge Nirzar Desai, Abdul Samad was clearly seen on the screen being in the toilet and performing physical activity.

Seeing the details of this case, two petitioners had filed an application in the Gujarat High Court to quash the complaint filed against them, which appeared in the court of Judge Nirzar Desai on June 20, 2025. In this case, even before the proceedings, the complainant Abdul Samad had joined the High Court online from his phone, which could be seen on YouTube.

Abdul Samad is a resident of Surat, who is into the business of battery and inverters. He had gone to the Jumma Masjid near Kim Railway Station to offer prayers. Accidentally, the door at the masjid touched one of the accused and he along with his brother abused Abdul Samad and assaulted him. The accused also warned Samad to not come to the masjid again.

Following the incident, Abdul Samad had filed a complaint in this regard at Kim Police Station in Surat. Immediately after the FIR was registered by the police, the complainant and the accused reached a settlement. However, the accused applied to the High Court to cancel the complaint against them.

As per the law, when a complaint is to be cancelled, the High Court asks the complainant's wish whether he wants to cancel the complaint? So Abdul Samad joined the High Court online to respond, but before the hearing of his petition was held, he entered the courtroom live from his toilet. In this live video, he went to the toilet and performed natural bodily functions, all the process was broadcast live on YouTube.

In yet another case, a video of a senior lawyer drinking beer surfaced during a virtual hearing in the Gujarat High Court. Taking note of this matter, the High Court on Monday initiated contempt of court proceedings against the lawyer.

This video is from June 26. In it, senior lawyer Bhaskar Tanna is seen drinking beer in front of Justice Sandeep Bhatt. The bench of Justice AS Supehiya and Justice RT Vachani, conducting the contempt proceedings, has termed Tanna's behavior as insulting.
