Amid the raging Rahul Gandhi vs Election Commission row, the Congress has called out the poll body over the affidavit it has filed in the Supreme Court. Accusing the poll body of committing "fraud" in Bihar, the Congress charged the Commission was "acting on its own whims."
Targeting the Commission, the Congress said in a post on X, "The Election Commission clearly stated in the Supreme Court - We will not disclose the names of the 65 lakh people in Bihar who were removed from the voter list; It was also said that there is no rule under which the reason for removing names must be provided or such information shared."
"It is clear- The Election Commission is completely acting on its own whims- crossing all limits to hide the fraud committed in the name of SIR," it added.
The Election Commission filed an additional affidavit on matters related to Bihar SIR in the Supreme Court on Saturday. The Commission informed the top court that it was not mandated by any statutory framework to publish reasons for exclusion of names from the electoral roll.
The Commission informed the Court that no voter's name would be deleted from the list without issuance of a prior notice. "As a matter of policy and in strict adherence to the principles of natural justice, no deletion of any elector's name from the draft electoral roll, published on August 1, 2025, shall be undertaken without: (i) issuance of a prior notice to the concerned elector indicating the proposed deletion and the grounds thereof, (ii) affording a reasonable opportunity of being heard and furnishing relevant documents, and (iii) passing of a reasoned and speaking order by the competent authority," it said.
The Supreme Court is hearing a bunch of petitions filed by Opposition parties against the special intensive electoral roll revision in poll-bound Bihar. The Opposition alleges the exercise would lead to disenfranchisement of 65 lakh voters from the voters' list. The Commission published the draft electoral roll for Bihar on August 1. The apex court has set date for final hearing in the matter on August 12 and 13.
