H-1B Visa Rule Change: The rules regarding H-1B visa are going to change soon in America. Now, the one who has a higher salary will get the H-1B visa first. The White House’s ‘Office of Information and Regulatory Affairs’ has approved the proposal, which can bring changes in the rules for granting H-1B visa to specialty occupation workers. Bloomberg Law has given this information in its report. The new rule will be released soon, so that people can comment on it.
US Citizenship and Immigration Services (USCIS) has not yet shared any information about the new rule. However, it is expected that USCIS is going to bring the plan of President Donald Trump’s government, in which H-1B visa applicants should be selected on the basis of the salary given to them. In simple language, the one who gets a higher salary will also get H-1B. Currently, visa is available through lottery, in which visa is issued only when the name comes.
What is H-1B visa?
In America, H-1B visa is given to foreign workers to do special or technical work in many fields including tech, healthcare, finance. Every year only 85 thousand visas are issued, out of which 65 thousand visas are given to foreign workers through lottery. Apart from this, 20 thousand visas are given to those students who have obtained a degree from an American university. In the selection done through lottery, everyone gets equal opportunity to get H-1B visa.
Trump has already introduced salary based visa system
In fact, the Trump government had also prepared to change the system of granting H-1B visas in its first term. At that time also, there was a plan to give visas on the basis of salary instead of selection through lottery. The Department of Homeland Security (DHS) had created four tiers of salary, in which people in the top tier were to be given visas first. The Trump government had brought this plan under the ‘Buy American, Hire American’ policy. But then this rule was changed as soon as Joe Biden became the President.
