New Delhi: In a major move, the Trump administration has now introduced a new method to deport immigrants from the United States, including Indians. According to the reports, the US immigration enforcement agencies are now identifying cases of unauthorized employment by immigrants on student visas or H-1B visas by scrutinizing Internal Revenue Service (IRS) records.
With this, those who went to the US on the H-1B visas but are earning from sources other than their primary employer, or students on visas who are working part-time in addition to studying, and who have not reported this additional income to the revenue department, may now face deportation. It could also result in denial of their visa extensions or refusal of entry into the United States.
As per the US immigration attorney Jath Shao, the Internal Revenue Service (IRS) has shared data of all immigrants with the Immigration and Customs Enforcement (ICE) department and alleged that many immigrants have engaged in unauthorized work. In the report, the IRS has stated that, in doing so, these immigrants have committed tax evasion.
Investigation into even minor past legal violations
- Actions are increasingly being seen in the case of H-1B visa holders who are being denied entry into the U.S. at embassies or ports of entry, according to a Times of India report quoting Jath Shao
- The reason given is that they allegedly earned extra income without authorization while on an F-1 student visa.
- Shao noted that even minor legal violations from the past are now being portrayed as major offenses.
- Shao explained that sometimes even when immigrants are caught for another offense—such as a traffic violation—their backgrounds are being scrutinized.
- Instances of unauthorized work done years ago, such as students working at a restaurant or a fast-food outlet, are now being treated as criminal acts.
