‘Sanjay Kapur signed will as a woman…’, Karisma Kapoor’s children allege use of feminine pronouns in father’s will

The Delhi High Court heard new arguments on Tuesday (October 14) in the ongoing dispute over the inheritance of late businessman Sunjay Kapur. The case, MS. Samaira Kapur & Anr v. Mrs. Priya Kapur & Ors, is in the news because Karisma Kapoor’s children, Samaira and Kiaan Kapoor, have challenged their father’s will in court. They claim the will is fraudulent and contains numerous discrepancies.

What is the ‘Will Controversy’?

The case was heard before Justice Jyoti Singh, where senior advocate Mahesh Jethmalani raised several serious issues. Jethmalani said that the will is not genuine because Sunjay Kapur is referred to as ‘She’ and ‘Her’ in several places, meaning feminine words. He said, “How can such an intelligent person write himself as a woman in his will?” He referred to a line which reads, “Signed and declared by Sunjay Kapur, the testatrix above named as and for ‘her’ last will.”

The Will Addressed ‘He’ as ‘She’

He said, “The word ‘testatrix’ refers to women, which shows that this will is a fake one.” The lawyer further stated that Sunjay Kapur is referred to as “She” four times in the will. He said, “A person who was so careful about his image and writing could not have made such a mistake.” Jethmalani called it a “ridiculous and defamatory document” and said that if Sunjay Kapur had actually read it, he would never have signed it. He added, “This will is going to damage his reputation.”

Jethmalani Targets Priya Kapur

During the hearing, Jethmalani also targeted Priya Kapur, saying, “She is, in a way, gambling to take control of her husband’s inheritance.” He added, “If the children are being called greedy, that’s wrong, because whatever they have inherited is the result of their grandmother and father’s hard work.” He told the court, “The real greed is written in this will.”
The lawyer further stated that no information was provided about the person who drafted the will. There is no proof, such as Sunjay Kapur’s handwriting, signature, or photo.

Priya Kapur owns 60% of the Property

Everything has been reported digitally. Witnesses have yet to submit detailed affidavits. He questioned, “Neither the time nor the place nor the person who wrote it is known. There is a lack of transparency in this entire process.” Jethmalani said that the will does not even mention Sunjay Kapur’s mother, Rani Kapoor, which is extremely strange. He said, “This shows that the will was drafted by someone who wanted to completely exclude Sunjay’s mother.” He also said that Priya Kapur now directly owns 60% of the property.

Trust Control and Next Hearing

He also stated that Priya Kapur controls 75% of the trust. The lawyer described this as “possession, not inheritance.” The next hearing in the case will be held on Wednesday, October 15th. Sunjay Kapur died on June 12, 2025, in England. According to reports, he died of a heart attack while playing polo. Some reports also stated that a bee landed in his mouth, triggering the heart attack. However, after his death, there is now controversy surrounding his will.
