Restrictions Imposed In Budgam Ahead Of By-Elections: DM Enforces Section 163 BNSS

Budgam, Nov 9: Authorities in Budgam on Sunday imposed restrictions under Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) in view of the upcoming by-elections for the 27-Budgam Assembly Constituency scheduled on November 11.
According to an order issued by District Magistrate Dr. Bilal Mohi-ud-Din Bhat (IAS) , the restrictions will remain in force from 6:00 PM on November 9 to 6:00 PM on November 11, coinciding with the 48-hour silence period mandated before polling.
The order states that no public meetings, rallies, processions, musical events, or any form of election campaigning will be allowed during this period, as per provisions of the Representation of the People Act, 1951. The DM said the measures were essential to ensure “free, fair, peaceful and transparent elections while maintaining public order and MCC norms.”
The restrictions also include a ban on unlawful assembly under Section 189 of the Bharatiya Nyaya Sanhita (BNS) 2023, and the use of loudspeakers after the campaign period is strictly prohibited.
However, the order clarifies that these restrictions will not apply to officials on election duty, including polling staff, magistrates, police personnel, and other government employees authorised by the District Election Officer.
The DM warned that any violation of the order will invite strict legal action. (KNC)
