47-year-old Saroja, whose husband had been working for the Kondai KSRTC since 2006, passed away while on duty on September 27, 2023. He was the sole breadwinner of the family. After her husband’s death, Saroja applied for a job on a compassionate appointment basis to support her family. But on January 17, 2025, the KSRTC rejected her application, citing her age as 47, while the scheme’s maximum age limit was 43. Saroja challenged this decision in the High Court.

Applying age limits mechanically is against humanity. In previous similar cases, the court has disregarded age limits and authorized appointments. Citing the Supreme Court’s decision in Canara Bank vs. Ajithkumar (2025), the court stated that any institution should consider whether a family is truly in financial distress before considering age.

The High Court has set aside the KSRTC order. It has also directed the KSRTC to reconsider Saroja’s application within eight weeks and consider how the age limit can be managed in her specific circumstances.
