Pvt doc lands in trouble for giving fabricated medical report for FIR
The Sarabha Nagar police on Friday registered a case against a private doctor who had submitted a wrong opinion in the medico legal report (MLR), which had led to the registration of an attempt-to-murder case against several persons, including a woman.
The doctor was identified as Jasvir Singh Kathuria. The suspect owns Deep Nursing Home Hospital, near Green Land School, Samrala Chowk. A case was registered under Sections 420 (cheating), 195 (giving or fabricating false evidence) and 197 (issuing or signing of false certificates) of the IPC.
A case was registered on the complaint of the then Civil Surgeon, Ludhiana, Jasbir Singh, after the medical board of doctors found the medical report submitted by the private doctor was fabricated.
As per the FIR registered against the doctor, the latter mentioned injuries as grievous ones and on the basis of the doctor’s report, a case under attempt-to-murder was registered against the four suspects, Baljit Singh, Sukhdev Singh, Tarandeep Singh and Paramjit Kaur, all residents of Sarabha Nagar.
SHO, Sarabha Nagar police station, inspector Madhu Bala, said a case was registered after receiving a report from the Civil Surgeon’s office. Now, further probe was launched and the suspect was yet to be nabbed.
What led to probe into fabricated MLR by doc
Palwinder Kaur, wife of one of the suspects, Sukhdev Singh, booked in the attempt-to-murder case, had written to the Civil Surgeon’s office and sought an inquiry regarding injuries of Daljit Singh, the complainant in the attempt-to-murder case. A five-member medical board was constituted on April 16, 2024. The inquiry report of board was sent to the Commissioner of Police, Ludhiana, on May 2, 2024, for further action with the recommendation to take legal action against Dr Kathuria, who not only declared the injuries of Daljit as grievous fraudulently but also did not follow guidelines of the state government and the Punjab and Haryana High Court. Also, there is no evidence of ‘dangerous to life injury’ in the case.
The Civil Surgeon also recommended action against the doctor to the PMC.
The Civil Surgeon in a letter to the Registrar, Punjab Medical Council, Mohali, had recommended to delete the name of Dr Jasvir Singh Kathuria permanently from the register of the Punjab Medical Council, Mohali, as per Section 7.7 of the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations 2002.
A medical board was constituted by the Civil Surgeon, Ludhiana, to inquire the matter. The board consist of Dr Varun Saggar, SMO, Hathur, Dr Davinder, SMO in the CHC Sudhar, Dr Ravi Datt, SMO, Manupur, Dr Gurbinder Singh Kakkar (forensic expert), Civil Hospital, Khanna, and Dr Aditya Prakash (Ortho). Neither the MLR number nor any consent/signature of the patient was taken. Also, Dr Kathuria did not mention the duration of injuries and kind of weapon. Also, the investigating official from the Sarabha Nagar police station, ASI Umesh Kumar, during his appearance before the inquiry panel failed to produce any medical record which could prove that any injury on Daljit Singh was dangerous to life in nature. From the available record, the board of doctors was of the unanimous opinion that there was nothing to suggest that any injury on Daljit was neither grievous nor dangerous in nature. Rather it was done fraudulently.
ASI, who probed case earlier, again made IO
Interestingly, ASI Umesh Kumar of Sarabha Nagar, who had earlier conducted investigation and registered an attempt-to-murder case, had again been made the investigating officer (IO) in the case.
