Police cancellation report in forgery case rejected
A local court has rejected a cancellation report filed by the Chandigarh Police in an FIR registered against directors of Chandigarh-based Atulaya Healthcare Pvt Ltd for forgery.
Observing that the probe has not been conducted properly, the court directed the police to further investigate the case.
The FIR was registered against Pankaj Kumar Kansil and Anuj Gupta, directors of Atulaya Healthcare, on the complainant of Vinod Kumar Singla, a resident of Sector 11, Chandigarh, for allegedly forging his signatures on a rent agreement and other documents.
As per the FIR, Singla told the police that he had started a clinical services business with Atulaya Healthcare on November 4, 2015, on the premises owned by him.
He alleged that Pankaj and Anuj, who also own another company by the name of Steadfast Healthcare Pvt Ltd, allegedly forged his signatures on the rent agreement, dated April 23, 2019, which stated that his premises had been rented out to them at Rs 5,000 a month.
In order to establish that they were running the business in the name of Steadfast Healthcare, the two even prepared a letter addressed to the Registrar of Companies, Chandigarh, purportedly executed by the him giving a no-objection certificate for registered office activity and address of Steadfast Healthcare.
Singla alleged that later he found out that the accused had forged his signatures on several other documents by breaching the agreement between Rameshwara Hospitals Pvt Ltd, of which he is director, and Atulaya Healthcare.
On his complaint, the police registered the case on June 27, 2022, under Sections 420, 467, 468 , 471 and 120-B of the Indian Penal Code at the Sector 11 police station. After three years of investigation, the police filed a cancellation report in the case.
However, the court rejected the report after complainant Vinod Kumar Singla appeared before the court, along with advocate Harish Bhardwaj, and alleged that the Investigating Officer has not conducted the investigation properly, fairly and scientifically.
He also alleged that the Investigating Officer has filed the cancellation report under the influence of the accused by conducting a biased and defective investigation, intentionally, ignoring the evidence clearly showing the commission of offence by the accused. Singla said he was not satisfied with the probe and the case may be sent for further investigation.
